Information on the newsletter and consent

We provide you with the following information to clarify the contents of our newsletter as well as the registration, sending and statistical analysis procedures and your objection rights. By subscribing to our newsletter, you agree to the receipt thereof and the procedures described.

Content of the newsletter
We only send newsletters, emails and electronic notifications with advertising information (hereinafter “newsletters”) with the consent of the recipients or with legal authorisation.If, in the context of subscribing to the newsletter, its contents are described in concrete terms, these contents are crucial for the consent of the users. We inform you approx. 6-8 times per year of general news, new service offers and events.

Double Opt-In and recording
The subscription to our newsletter consists of a so-called Double Opt-In procedure. This means that after subscribing, you receive an email in which you are asked to confirm your subscription. This confirmation is necessary to prevent anybody from subscribing with foreign email addresses.

The subscriptions to the newsletter are recorded so as to be able to prove the subscription process in accordance with the legal requirements. This requires the storage of the time of the subscription and confirmation, as well as the IP address. Similarly, the changes to your data saved by MailChimp are also recorded.

Use of the delivery service provider “MailChimp”
The newsletter is sent via “MailChimp”, a newsletter delivery platform of the US provider Rocket Science Group, LLC, 675 Ponce de Leon Ave NE #5000, Atlanta, GA 30308, USA.

The email addresses of our newsletter recipients, along with their additional data described in the context of this notice, are stored on the MailChimp servers in the USA. MailChimp uses this information to send and analyse the newsletter on our behalf. Furthermore, according to the information provided by MailChimp, it can also use these data to optimise or improve its own services, e.g. for the technical optimisation of the sending process and the display of the newsletter or for economic purposes, in order to determine the countries from which the recipients originate. However, MailChimp does not use the data of our newsletter recipients to write to them itself or to pass it on to third parties.

We have confidence in the reliability as well as the IT and data security of MailChimp.MailChimp is “Privacy Shield” certified in accordance with the US EU data protection agreement and thus commits to comply with the EU data protection requirements. Furthermore, we have concluded a data processing agreement with MailChimp. This is a contract in which MailChimp commits to protect the data of our users, to process these data on our behalf in accordance with the data protection regulations and, in particular, not to pass these data on to third parties. Subscription data
To subscribe to the newsletter, it is sufficient to provide your email address. You also have the option to provide further personal data, namely: first name, surname, email address, address, postcode, city, country. These are processed for the purpose of sending the electronic Revital Aspach & Villa Vitalis newsletter as well as for the mailing of informational material. You may revoke this consent at any time. By clicking on the option “Unsubscribe”, you can opt out of receiving the newsletter at any time. Your data are not forwarded to third parties.

Statistical survey and analyses
The newsletters contain a so-called “web beacon”, which is a pixel-sized file that is called up by the MailChimp server when you open the newsletter. Calling up this file initially means that technical information such as information on the browser and your system as well as your IP address and the time of calling up is collected. This information is used for the technical improvement of the services using the technical data or the target groups and their reading behaviour by means of their call-up locations (which can be determined with the help of the IP address) or the access times.

The statistical surveys also include establishing whether the newsletters are opened, when they are opened and what links are clicked on. Due to technical reasons, it is possible for this information to be associated with the individual newsletter recipients. However, it is neither our intention nor that of MailChimp to observe individual users. Rather, the evaluations support us in recognising the reading habits of our users and adapting our contents to fit them or sending different contents in accordance with our users’ interests.

Online access and data management
There are cases in which we direct the newsletter recipients to MailChimp’s web pages. For example, our newsletters contain a link with which the newsletter recipients can call up the newsletter online (e.g. if there are problems displaying it in the email programme). Furthermore, newsletter recipients can correct their data later on, for example their email address. Similarly, MailChimp’s data protection statement can only be called up on their page.

In this context, we point out that on MailChimp’s web pages, cookies are used, meaning that personal data are processed by MailChimp, their partners and the service providers they employ (e.g. Google Analytics). Cancellation/revocation
You can cancel the receipt of the newsletter i.e. revoke your consent at any time. With this, your consent to it being sent via MailChimp and to the statistical analyses is also deleted at the same time. Unfortunately, a separate revocation of the sending via MailChimp or the statistical evaluation is not possible.

Legal grounds General Data Protection Regulation
In accordance with the provisions of the General Data Protection Regulation (GDPR), effective as of 25th May 2018, we inform you that the consent to the sending of the email addresses takes place based on Art. 6 Para. 1 lit. a, 7 GDPR as well as § 7 Para. 2 No. 3, and Para. 3 Unfair Competition Act (UWG). The use of the delivery service provider MailChimp, the performance of the statistical surveys and analyses as well as the recording of the subscription process take place based on our legitimate interests pursuant to Art. 6 Para. 1 lit. f GDPR. Our interest focuses on the application of a user-friendly and secure newsletter system that serves not only our commercial interests, but also meets the users’ expectations.

Furthermore, we point out that, in accordance with the legal provisions pursuant to Art. 21 GDPR, you may object to the future processing of your personal data at any time. This objection may take place in particular for the processing for the purposes of direct advertising.
